RENTAL TERMS AND CONDITIONS
The content of the Contract that has been prepared and drawn up unilaterally by AUTO LAND and to be executed by AUTO DESTEK SERVİS HİZMETLERİ A.Ş. (MERSİS NO : 0329159721900001) (hereinafter briefly mentioned as AUTO LAND) for the daily rental service to be provided by AUTO LAND is being presented to you, our customers, below.
I- TERMS AND CONDITIONS ABOUT DRIVERS
Only the person(s) specified in the contract and delivery form can drive the rented car. No damage assurance is valid for damages that may occur if third parties not specified in the contract drive the vehicle. In order to increase the number of drivers of the rented car, you can purchase “Additional Driver” service from our branches or during online reservation..
Driver’s License and Rental Age Limitations
If the car that the customer wants to rent is from economic group , the customer must be at least 23 years old and have a 2-year driver’s license, for medium group cars he/she must be 26 years old and have a 3-year driver’s license, and for premium group cars, he/she must be 30 years old and have a 4-year driver’s license.
Both the Customer and the additional driver must meet these conditions. There must be T.R ID no written on the driver’s license. It is not possible to rent with driver’s licenses combined with new identity cards. You must have your driver’s license with you.
In the event that the CUSTOMER does not meet the age and driver’s license requirements for the rental of the car but has already rented one of the cars , AUTO LAND will not deliver the car to the CUSTOMER. In this case, if the payment is made online, the paid rent will be considered as a penalty by AUTO LAND and will not be refunded; if the CUSTOMER has not paid the rental price yet, then he/she shall pay the penal fee in the amount of the rental price for 1(one) day to the bank account of the AUTO LAND in cash and at once without any delay.
Financial Conditions
AUTO LAND conducts car rentals by analyzing the risk history of the CUSTOMER and the additional driver before the car is delivered, and may not offer car rental services to people whom it does not deem appropriate in terms of financial risk status or rental criteria. In this case, the price paid by the customer, if any, will be returned to him/her.
II- RENTAL PERIOD, EXTENSION OF TIME AND PENALTY CONDITIONS
Our cars can be rented for at least 1 day. For rentals with a rental period of less than 24 hours, the rental fee will be charged over the 1-day rate. For rentals with a rental period of 31 days or more, the monthly rental fee is determined.
Upon the expiry of the rental period, the CUSTOMER will not be able to extend the rental period unilaterally. The rental period can be extended with the approval of AUTO LAND. In case the rental period is extended, a car other than the one agreed in the contract may be offered. In this case, the previous car must be returned.
If AUTO LAND does not approve the extension request and the vehicle is not returned, a penalty fee of three times the rental price shall be charged in addition to the daily rental fee for each day the vehicle is not returned.
III- PAYMENT CONDITIONS, SECURITY DEPOSIT AND SAFETY
Payments for the daily rental price of the car and all other expenses will be made at the beginning of the rental period with a valid credit card specified by the CUSTOMER or in cash.
In addition, at the beginning of the rental period, a collection will be made from the credit card specified by the CUSTOMER or in cash as a guarantee/security deposit -according to the nature of the car subjected to the Contract and the rental period- in an amount to be appreciated by AUTO LAND. This collected security deposit is fully refunded within 15 days at the latest if the vehicle is taken back as it was delivered to you and AUTO LAND does not have any other receivables arising from the Contract. AUTO LAND will be authorized to collect traffic fines, HGS (Rapid Pass System) Toll Fees, parking fees, service fees, damage costs and all kinds of contractual receivables arising from the abovementioned security deposit during the rental period. In case the collateral is not sufficient, the CUSTOMER shall pay the balance debt separately.

IV- FUEL OIL
Fuel oil cost shall be paid by the customer. How much fuel the vehicle has when it was delivered and how much fuel the vehicle has when it was returned by the Customer will be recorded with the Car Delivery Form to be issued at the time of vehicle delivery. If the fuel tank rate at the return of the vehicle is lower than the rate at the time of the first delivery of the vehicle; the fuel price to be calculated in proportion to the missing fuel and the 40% fuel service fee to be calculated over this price will be collected from the Customer.
V- KILOMETERS / MILEAGE LIMITS AND LIMIT EXCESS
Vehicles have daily mileage limits, which are determined for each vehicle at the beginning of the contract. In case the specified mileage limits are exceeded, 4 TL per kilometer exceeding fee is collected from the Customer. If you wish, you can increase your mileage limit by purchasing additional mileage packages in the VIII- ADDITIONAL PRODUCTS, INSURANCE AND SERVICES section. Information on mileage limits is as follows:

VI- HGS (RAPID PASS SYSTEM), TRAFFIC FINES, PARKING PRICE ETC. AND SERVICE FEES
All costs such as HGS (Rapid Pass System) tolls, parking fee, traffic fine, towing fee etc. to be made during the rental period and 25% service fee to be calculated over these costs will be paid by the Customer.
If the standard HGS(Rapid Pass System) limit is not sufficient (Yavuz Sultan Selim Bridge, Osmangazi Bridge, Eurasia Tunnel, etc.) to pass through the routes, AUTO LAND should be informed during the establishment of the Contract and the appropriate balance should be loaded to the HGS system. All HGS transit fees and ancillary fees (illegal transit fine, attorneyship and litigation costs, etc.) to be made during the rental period and the service fee will be paid by the Customer. In the event that the security deposit amount shall be insufficient to meet the toll fees or in case of any infringed pass; the residual amount which could not be collected shall be separately collected by the Customer.
VII- DELIVERY AND RETURN OF THE CAR
The car will be delivered against the contract/vehicle delivery form and the car will be returned as clean as was delivered to the AUTO LAND office/delivery point where the vehicle was delivered as it was received. If the vehicle is to be delivered to another delivery point, the relevant additional service package must be purchased. In case of returning the car to a different service point without purchasing this package, AUTO LAND collects the additional service package fee determined for the return to the different delivery point from the customer.
The customer must check the car while receiving and delivering the vehicle and sign the delivery form, making sure that the car delivery form is prepared in accordance with the condition of the car. After the delivery of the car, the report cannot be claimed otherwise.
The customer will return the car to AUTO LAND at the end of the lease term or in the event that the contract is terminated by AUTO LAND due to the breach of the customer’s obligations or the contract is terminated for any reason.
It is obligatory to deliver the car on the return day and time agreed at the beginning of the contract. No additional fee is charged for delays exceeding the agreed delivery time by up to 1 hour. However, for delays between 1 hour and 3 hours (including these hours), 1/3 of the daily rental fee is charged, and for delays exceeding 3 hours, 1 day rental fee is charged as a penal clause.
No refund will be made in case of early return.
In addition, if the car is not brought for more than 2 days even though the rental period has expired, it is considered an abuse of trust in terms of AUTO LAND, and in this case, the current market price of the vehicle and all damages are demanded and collected from the LESSOR. In addition, there are legal and penal sanctions for not delivering the car.

IX- REFLECTION AMOUNTS AND SERVICE FEES APPLIED TO DAMAGES DETECTED TO THE VEHICLE
Our customer is not responsible for the wear and tear caused by ordinary use during the return of the car at the end of the contract. However, the customer will be responsible for all kinds of damage and wear and deficiencies in the car equipment, which have occurred outside of normal use and have been determined in the car return report. In addition, in cases outside the scope of insurance coverage or in cases where there is use contrary to the contract, reflection will be made in accordance with the figures in the table. The damage cost table to be applied on the return of the vehicle is as follows. In addition, 5% damage service fee will be charged separately over the applied damage reflection amount.

It is obligatory to keep the license plate holders with the AUTO LAND brand and contact information on the vehicles during the rental period. Otherwise, it will be considered as a violation of the terms of the contract. The plate fee in the table will be reflected in the vehicle returns made without the plate base.
In accidents where the Customer is at fault, the amount of damage to be calculated according to the defect rate and 5% of the damage amount shall be collected from the Customer; in the case of additional package purchases, the Customer will be charged the damage amount above the limit and the service fee of 5% of the damage cost. For all kinds of damage other than the insurance coverage, the damage amount and a service fee of 5% of this amount shall be charged.
X- INSURANCE COVERAGE AND ACTIONS TO BE TAKEN IN CASE OF AN ACCIDENT
Mandatory liability insurance of vehicles is made by our company. All kinds of material and physical compensation and expenses arising from the damage caused to third parties during the rental period of the rented car are covered within the scope of the compulsory traffic insurance limits made by AUTO LAND (except for the exceptions in the contract and rental conditions). The CUSTOMER is responsible for the rights and claims outside the insurance coverage (fake report, alcohol use, leaving the scene, driving without a license, etc.) or above the insurance limits.
In case of damage to the car, only the AUTO LAND car and its driver in one-sided accidents, and all vehicles and drivers together in accidents involving more than one vehicle, the originals or certified photocopies of documents such as traffic accident report, alcohol report, driver’s license photocopy are issued and must be delivered to AUTO LAND within 24 hours at the latest. Otherwise, the Customer will be charged a service fee of 5% over the cost of damage, the rental fee for the days spent in repair of the vehicle and for the resulting damage, and the damage amount.
If you wish, you can benefit from additional insurance coverage to the standard insurance packages by purchasing the additional insurance packages in the VIII- ADDITIONAL PRODUCTS, INSURANCE AND SERVICES section.
XI- CAR TRACKING
AUTO LAND uses car tracking system in vehicles in order to protect both public safety and all its legitimate rights, especially the right of ownership. AUTO LAND undertakes not to access location information and not to share it with third parties and institutions unless it is necessary for public safety or legitimate interest.
Dismantling and/or disconnection of the car tracking system will be considered as a breach of contract for AUTO LAND.
XII- SITUATIONS/CASES IN WHICH THE DAMAGE SHALL BE CHARGED DIRECTLY TO CUSTOMER
– The Customer accepts and undertakes not to not to use and/or to use the car in the transportation of the goods, the transportation of which is in violation of T.R laws and regulations, particularly of Customs laws and firearms legislation, and/or in other unlawful works, not to make any changes to the car, not to make any paid transportation, not to carry passengers and goods for commercial purposes, not to damage the car and exceed the loading limit, not to carry cargo and goods, not to transport sacrificial animals and/or meat, not to use the car in cattle / meat transportation, not to use the car in tramp and non-scheduled ferries, not to use it out of the roads, not to use it for towing other vehicles and not to attach a trailer to the car, not to use it for racing, rally, motor sports and on closed and unsuitable roads for traffic such as mountainous terrain, sand, swamp, stream bed, etc. and that he/she accepts and undertakes that he/she will not use or have the car used in places such as places and on roads that are not suitable for the endurance or tolerance of the car and for another purpose, he/she also accepts and undertakes that he/she will not drive or have the car used while under the influence of drugs or under the influence of alcohol. In such cases, the Customer will be responsible for the damages, regardless of whether they are covered by insurance and automobile insurance.
– All kinds of damage, repair costs and all other costs and losses and external factors (wrong fuel filling or use of fuel that is not suitable for the manufacturer’s brand, etc.) due to user error or the behavior of the Customer against its obligations under the contract will be covered by the Customer, regardless of whether it is covered by motor insurance or traffic insurance.
– If the car shall be stolen as to be out of the Customer or additional drivers (leaving the key on the car, stolen car with the key, etc.) and if the possession of the car is lost for any reason, the Customer is obliged to cover all other damages that AUTO LAND will suffer, especially the market value of the stolen / lost car.
– In case of damage to the vehicle, only the AUTO LAND car and its driver in unilateral accidents, and all vehicles and drivers together in accidents involving more than one vehicle, the originals or certified copies of documents such as traffic accident report, alcohol report, photocopy of driver’s license are issued and must be delivered to AUTO LAND within 24 hours from the date of the accident. Otherwise, the cost of damage, the damage, and the rental cost of the car for the days spent in the repair will be covered by the CUSTOMER.
– In case of any radio, spare wheel, tools, etc. to be stolen / lost from the car, the Customer is obliged to pay the price for them. If the additional insurance package is not purchased, the Customer is fully responsible for the splitting of the tire, damage to the rim, theft of the wheel cover and spare wheel, damage to the license, plate, fire extinguisher and equipment.
– In accidents that may occur due to violation rule of any additional driver (such as excessive speed, entering the opposite direction, traffic light rule violation, drifting, crossing, etc.) or the Customer in case of the product purchased; if it is determined that the traffic rule violation was made by the Customer or the user to whom the vehicle was delivered, in the traffic accident detection reports to be kept regarding these accidents or by any other evidence, AUTO LAND regarding the damages that may occur in the vehicle regardless of whether it is covered by the Customer or not, or what the additional driver defect rate is or what the coverage of traffic policy is. The entire cost of repair and depreciation to be determined by the AUTO LAND and 5% of the service fee that shall be calculated over this amount shall be paid by the Customer.
– If the vehicle is hit by any animal or creature while the car is been driven (whether due to the fault of the customer or the additional driver or not), or if the vehicle is damaged by an animal while the vehicle is parked, the entire damage will be covered by the Customer.
XIII- CANCELLATION/WITHDRAWAL CONSITIONS AND PENALTY CLAUSE
he Customer has no right of withdrawal in accordance with the provisions of Article 15/1(g) of Distant Contracts Regulation which was entered into force after being published in the Official Gazette no. 29188 and in accordance with the provisions of Law no. 6502.
However, if the Customer cancels the reservation more than 24 hours before the delivery date of the car, the entire amount paid will be refunded to the credit card of the Customer. If the cancellation request is made less than 24 hours before the requested/agreed delivery time of the car, or if the car is not received on the specified day and time without a cancellation request, the remaining amount will be refunded to the credit card of the Customer after a penalty deduction equal to the 3-day rental fee is made. If the reservation is less than 3 days, no refund will be made.
XIV- RIGHT OF TERMINATION OF THE LESSOR AND PENALTY CONDITION IN CASE OF ANY USE AS BREACH TO THE CONTRACT
AUTO LAND has the right to terminate the contract unilaterally in the event that the car is used by any person(s) other than the customer or the additional driver and/or the leased car is used outside of the terms of the contract and for the purpose, or if the customer does not fulfill its contractual obligations at all or properly. In this case, AUTO LAND is entitled to collect the entire rental price and no refund will be made to the Customer. In addition, if AUTO LAND has any loss or damage arising from breach of contract, it may demand compensation from the customer for these losses.
